Our Approach to Litigation
Effective litigation requires careful assessment of the facts, evidence, applicable law, and procedural requirements. We begin by understanding the dispute, reviewing the relevant documents and evidence, identifying the legal issues and potential claims, and evaluating the available options and their implications.
At MERVA Law & Arbitration, we believe that protecting a client's interests does not necessarily begin with filing a lawsuit. It begins with understanding the client's legal position and providing advice on the most appropriate course of action.
Before recommending court proceedings, we assess the legal basis of the claim, the available evidence, the prospects and risks of litigation, and the potential costs and duration of the proceedings. Our objective is to help clients make informed decisions with a clear understanding of their options.
We do not regard litigation as the best course in every case. Depending on the circumstances, negotiation, amicable settlement, or another legal measure may better serve the client's interests. We are committed to providing candid and clear legal advice, including when our recommendation is not to pursue litigation.
Where court proceedings are appropriate, we pay particular attention to procedural deadlines, the organization of supporting documents, the preparation of pleadings and legal submissions, the clarity of the legal position, and keeping clients informed of material developments in their cases.
Our role extends beyond representation before the courts. It includes helping clients make considered legal decisions that take account of their rights, interests, and the potential consequences of each available course of action.
